There are hereby incorporated by reference as if set out fully herein, the zoning regulations adopted by the governing body of the City of Harveyville, Kansas, as prepared by the city and consisting of Ordinance No. 232 and entitled, “Zoning Regulations of the City of Harveyville, Kansas.” No fewer than three copies of the zoning regulations, marked “Official Copy as Incorporated by the Code of the City of Harveyville” and to which there shall be a published copy of this section attached, shall be filed with the city clerk to be open for inspection and available to the public at all reasonable business hours.

(a)   For the purpose of wholly or partially defraying the costs for processing applications for actions taken under the Harveyville zoning regulations, there is hereby established a schedule of fees as follows:

(1)   Application for Rezoning (no separate fee for development plan): $150.

(2)   Application for Conditional Use: $75.

(3)   Application for Development Plan Approval separate from Rezoning or Conditional Use Application: $50.

(4)   Application for Variance or Special Exception: $150.

(5)   Application for Appeal to Board of Zoning Appeals: $50.

(6)   Application for Zoning Certificate (primary building): $25 or $.20 per square foot, whichever is greater.

(7)   Application for Zoning Certificate (accessory building): $15.

(8)   Application for Sign Permit: $10.

(b)   All costs associated with recording documents, placing legal publications, and mailing publications to adjoining landowners shall be payable in addition to the fees stated in subsection (a) above. These will be separately billed to the applicant and must be paid prior to final disposition of the application.

(c)   No fee shall be refunded in any event.

(d)   A written receipt shall be issued to the person(s) making payment of the fee. No fee shall be required when a proposal concerns land owned by any township, city, county, state, or the federal government; nor any agency, board, or legal entity thereof; nor from any public school or college.

Any person or corporation who shall violate any of the provisions of these regulations or fail to comply herewith, or with any of the requirements thereof; or who shall build or alter any building in violation of any detailed statement or plan submitted and approved hereunder shall be guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine of not more than $500 and/or imprisonment for not more than six months for each offense and each day such violation shall be permitted to exist, and any architect, building, contractor, agent, person, or corporation employed in connection therewith, and who assisted in the commission of any such violation, shall be guilty of a spare offense and upon conviction thereof shall be subject to the same fine as herein before provided.

(a)   The Wabaunsee County Regional Planning Commission has submitted to the Governing Body of the City of Harveyville a Flood Plain Management Ordinance in narrative form outlining and describing the intention of the city for future development or redevelopment of the City of Harveyville all in accordance with K.S.A. 12-741 et seq. and specifically K.S.A. 12-766.

(b)   The Flood Plain Management Ordinance as presented by the Planning Commission is approved as the plan has been presented to the Governing Body of the City of Harveyville.

(c)   The Flood Plain Management Ordinance in its entirety is available in the office of the City Clerk for review.
